A Corporate Agent registered under the IRDAI (Registration of Corporate Agents) Regulations, 2015 is required to comply with various regulatory, operational, reporting, and governance requirements prescribed by IRDAI. Broadly, the compliance requirements applicable to a Corporate Agent may be classified into the following categories:
- Regulatory, Governance and Policy Related Compliances
- Half-Yearly Returns and Reporting Compliances
- Annual Returns and Year-End Compliances
In this section, we will discuss the annual compliances applicable to a Corporate Agent. Most of these compliances are linked to the financial year ending on 31st March and are required to be completed and reported within the timelines prescribed by IRDAI.
Theses compliances includes the submission of following certificate and reports
- Schedule VI A Certificate:- Certificate to be submitted by the insurer duly signed by the CEO and CFO of the company on the remuneration and other payments made to a Corporate Agent
- Schedule VI B Certificate: - Certificate submitted by the Corporate Agent, duly signed by the CEO and CFO of the Company/Entity, certifying the remuneration and other payments received from insurers during the financial year.
- Schedule VI Premium and Commission Statement: - This statement provides details of insurance premium sourced and commissions/remuneration earned during the financial year. It is submitted insurer-wise and line-of-business-wise
- Audited Financial Statements: - Every Corporate Agent is required to submit its audited financial statements, including the Balance Sheet, Profit & Loss Account, Auditor's Report, and Notes to Accounts.
- Professional Indemnity Insurance Policy: - A Corporate Agent must maintain a valid Professional Indemnity Insurance Policy throughout its registration period. Annual submission of the policy copy and renewal details confirms that adequate insurance coverage exists against errors, omissions, negligence, or professional liabilities arising from insurance distribution activities.
- Compliance Certificate:- This certificate confirms that the Corporate Agent has complied with the provisions relating to tele-marketing and other distance marketing modes as prescribed under Schedule VII (Para 7 to 11) of the applicable IRDAI guidelines. It also certifies that the standardized product scripts have been filed under the "Use & File" procedure and that all telemarketers engaged by the Corporate Agent have complied with the prescribed regulatory requirements during the financial year.
